Winter World Masters Games 2024 Lombardy, Italy 11 – 21 January 2024.

I acknowledge and accept that, in order for my application to participate in the Games to be accepted by WWMG Lombardy 2024, I must accept the following terms and conditions of admission.

I acknowledge and accept that these terms and conditions cannot be changed.

I acknowledge and accept that if my request to participate in the Games is accepted, I will participate in the Games and associated activities at my own risk and that WWMG Lombardy 2024 reserves the right to modify any aspect of the Games activities at any time and for any purpose.

Such changes may include, but are not limited to, changing the applicable sports, events or age groups that comprise the Games activities and/or rescheduling or cancelling any of the Games activities.

I acknowledge and agree that I will not have the right to assert any claim or demand against WWMG Lombardy 2024, IMGA or the host cities or any sporting organization for any damages suffered by me as a result of any such changes.

I acknowledge that WWMG Lombardy 2024 complies with the provisions and regulations of the IMGA and the Italian state regarding any restrictions on participants, for example due to visas or other regulations and provisions.

1. INTERPRETATION

For the purposes of these terms and conditions:

“Request for compensation” means and includes any action, suit, proceeding, claim, demand, damage, cost or expense, in whatever manner it might be introduced, including but not limited to negligence.

“WWMG Lombardy 2024” refers to the organization of the Winter World Masters Games Lombardy 2024, its Organizing Committee, its officers, employees, agents and volunteers.

“Games” refers to the Winter World Masters Games 2024 Lombardy.

“Games Activity” means the performance or participation in any capacity in any authorised or recognised sport, event or activity of the Games.

“Images” refers to any photos or electronic images and/or recordings.

“IMGA” refers to the International Masters Games Association.

“Rules” refers to the rules, regulations and policies of WWMG Lombardy 2024 and the rules of the sports governing any activity of the Games in which I participate, as they vary from time to time.

“Third Party”, refers to whenever there is a transaction between two or more persons or entities, any other person or entity which does not have a direct link to the interaction but which may be influenced by it.

“WADA” refers to the World Anti-Doping Agency.

2. REGISTRATION

My application to participate in the Games might be accepted at the discretion of WWMG Lombardy 2024.

In particular:

(a) I acknowledge that the closing date for entries for the games is 1 December 2023 by 12.00 a.m. and that if my application arrives incomplete and/or after this date, I understand that my application will not be accepted.

(b) I am aware that some sports may have a maximum number of participants and that WWMG Lombardy 2024 reserves the right to accept entries in order of receipt, until the maximum number of entries has been reached.

I further acknowledge that if insufficient participant numbers are obtained the age ranges may be combined or events and games cancelled.

WWMG Lombardy 2024 and other relevant authorities reserve the right to change the dates, times and venues of the sports as a result of unforeseen circumstances which include, but are not limited to, cases of force majeure, extenuating circumstances, any security measures or organizational requirements. WWMG Lombardy 2024 assumes no liability for omissions or defaults, non-compliance, negligence or otherwise, by any third party suppliers, airlines, bus operators, shipping companies, hoteliers or other entities providing services in relation to the accommodation package and hospitality.

3. ELIGIBILITY AND REQUIREMENTS

I certify that I am medically and physically fit and able to participate in the Games and associated activities. I understand and accept that WWMG Lombardy 2024 will use this statement as proof of my eligibility and capability to participate in the Games and various activities.

4. PROCEDURES IN THE EVENT OF ILLNESS AND INJURY

I acknowledge and agree that should I suffer an injury or illness while participating in the activities of the Games, I authorize WWMG Lombardy 2024 to execute, administer or obtain any medical assistance deemed necessary by WWMG Lombardy 2024.

I acknowledge and accept that I am personally responsible for all expenses incurred as a result of any such injury or illness, including transportation, hospitalisation, medical care, and any other related services or treatments performed or administered.

5. RULES

I agree to abide by the Rules and all written and oral instructions as may be issued or ministered by WWMG Lombardy 2024 from time to time.

I acknowledge and accept that if I am unable to comply with the rules or instructions given by the organisation, I may be disqualified from the Games or from any activity at the Games. I agree, at all times, to participate in the Games with fair play and sportsmanship and will not behave in a way that harms the good order, reputation, safety or discipline of the Games or of WWMG Lombardy 2024.

6. CAUTIONS

The Activities of the Games can be inherently dangerous. I acknowledge that I am exposed to certain risks while playing the Games, including but not limited to:

(a) I could be physically or mentally injured, disabled, maimed or killed;

(b) other participants may act dangerously or with lack of skill;

(c) conditions may be dangerous and may change without notice, warning or predictability;

(d) organisers, match officials, venue owners/managers and any agent or representative of any one of them in charge of an event, may be forced to make decisions under pressures of time and/or event;

(e) any insurance policy relating to my health or life may be cancelled;

(f) my property/belongings may be damaged, lost or destroyed.

I recognize that accidents can, and often do, result in injury either to me or damage to my property. I have read and understood this advisory and accept and assume the risks inherent in participating in the activities of the Games.

7. INSURANCE

I acknowledge that the fees paid by me to WWMG Lombardy 2024 do not include any injury/accident insurance. I acknowledge that WWMG Lombardy 2024, IMGA, the host cities or any sporting organization assisting WWMG Lombardy 2024 in carrying out the Event, have not assumed any responsibility in approving, nor have they provided any advice as to the scope or appropriateness of any insurance policy I could take out.

8. AGE POLICY

I agree to abide by the prescribed age limits, as indicated on the entry form. I agree to provide photographic proof of my age when requested to do so by WWMG Lombardy 2024 or its staff.

9. ANTI-DOPING POLICY

The use of WADA-prohibited substances and methods by a competitor is prohibited during the Games. I acknowledge and agree that WWMG Lombardy 2024 (and its designated agents) reserve the right to subject any registered competitor, at any time during the period of the Games, to a test for the presence of any prohibited substances or methods as required by WADA. WWMG Lombardy 2024 recognises that some substances banned by WADA may be permitted upon presentation of adequate medical evidence.

10. PRIVACY POLICY

I accept that the entry database will be shared with IMGA for purposes of promoting future Winter Masters Games and Masters sport in general. Participants’ personal data will be used in accordance with relevant rules and regulations, including the IMGA privacy policy.

11. USE OF IMAGES AND LOGO

I acknowledge and accept that photographs may be taken of me during my participation in any Games activity. I acknowledge and accept that such images are the property of WWMG Lombardy2024 and IMGA and that WWMG Lombardy 2024 and IMGA may publish, reproduce, modify and otherwise use (including by authorizing third parties to do the same) the images for promotional or other purposes kind (including, but not limited to, art, advertising, commerce, visual documentary, merchandising, or television coverage) without my further consent being required. All people who participate in the games accept, without any compensation, that their voice, their images and their photos can be transmitted live or in a pre-recorded version or in any other form and used by the participating mass media. Persons participating in the games may not record or transmit any sounds, images, comments, results and/or statistics about the games other than for personal/private use.

Furthermore, I give my consent for WWMG Lombardy 2024 to use my name, image and performance in the Games activities, at any time, exposed in any way, in order to promote WWMGLombardy 2024 and/or the Games.

I further acknowledge and agree not to make any unauthorized reproduction of the Games logo or use the wording “Winter World Masters Games 2024 Lombardy” or any variation thereof, on any form of merchandising, promotional materials, personal or team apparel, stationery or other product.

12. PAYMENT

I acknowledge and accept that entry is only confirmed upon receipt of full payment of the entry fee. Any additional costs for bank transfer or other payment methods will be charged to the customer.

13. REFUND POLICY

Thanks to the collaboration with ENDU and YOLO, a digital insurance brokerage service company, with the payment of the registration fee for the WWMG Lombardy 2024, the ENDU Restart policy is made available free of charge to each member, valid in case of impossibility to participate.

14. THIRD PARTY SUBSCRIPTIONS

In the event that I nominate a third person as a participant in the Games, I guarantee that I am expressly authorised to complete this entry on behalf of the third person I am nominating. I further guarantee that:

(a) the third party has authorised me to accept the terms and conditions of registration of WWMGLombardy 2024.

(b) I will provide the third party with a copy of these terms and conditions at the end of the registration process; and

(c) I will inform the third Party that they will be deemed to have accepted these terms and conditions by participating in the Games Activities.

15. APPLICABLE LAW AND JURISDICTION

These terms and conditions will be interpreted in accordance with and governed by the laws of the Italian Republic. The form, execution, validity, construction and effects will be determined according to the Italian laws and the parties submit to the jurisdiction of the Italian courts.

The undersigned guarantees that all information provided to WWMG Lombardy 2024 is true and correct.

I have read, understood, acknowledged and agree to these terms and conditions, including advisory notices, disclaimer of implicit terms, waiver and reimbursement.
